Surprise Promotion – Terms and Conditions

The Surprise Promotion (the “Promotion”) is offered by Eko Health, Inc (“Eko”).

This Promotion is intended as a limited-time sales promotion and not as a game of chance or lottery.

Promotion Period

The Promotion is active at any time the Promotion opt-in is displayed during checkout on EkoHealth.com (the "Promotion Period"). Eko may discontinue the Promotion at any time by removing the Promotion opt-in from the checkout process. Orders placed after the Promotion opt-in is removed are not eligible for the Promotion. No advance notice of discontinuation is required.

Promotion Offer

During the Promotion Period, customers purchasing a CORE 500™ Digital Stethoscope through Eko’s website will receive the then current promotional discount price.

In addition, during the Promotion Period, Eko will designate one (1) eligible CORE 500 order to receive a full refund of the order amount, including the purchase price, applicable sales taxes, and shipping charges.

Eligibility

The Promotion is available to customers located in the United States who place an eligible order through Eko’s official website during the Promotion Period.

Limit one (1) device per customer with a refund value up to $1,000.

The Promotion applies only to retail purchases and does not apply to bulk orders, reseller orders, distributor purchases, or other commercial transactions.

Refund Selection

Refunded orders will be selected by Eko, in its sole discretion, from among eligible orders placed during each calendar day of the Promotion Period.

Customers whose orders are selected will be notified via the email address associated with the order within approximately thirty (30) days following their selection.

Refunds will be issued to the original payment method used for the purchase and may take up to ten (10) business days to process after confirmation.

Order Eligibility

Orders that are cancelled, returned, fraudulent, suspected of abuse, or otherwise determined by Eko to be ineligible may be disqualified from the Promotion. In such cases, Eko may select another eligible order.

Returns

All purchases remain subject to Eko’s standard return and refund policies.  If a refunded order is subsequently returned, Eko reserves the right to recover the refunded amount or offset it against any return credit.

Publicity

By participating in the Promotion, customers whose orders are selected for a refund grant Eko the right to use their first name, last initial, and city and state for promotional and announcement purposes related to the Promotion, including on Eko’s website, social media, or marketing communications, without additional compensation, except where prohibited by law.

Promotion Administration

All determinations by Eko regarding eligibility, order validity, and promotion administration are final.

Modification or Cancellation

Eko reserves the right, in its sole discretion, to modify, suspend, or cancel the Promotion at any time and for any reason, including but not limited to technical issues, fraud, legal requirements, or other circumstances that could affect the integrity or administration of the Promotion.

Limitation of Liability

By participating in the Promotion, customers agree that Eko and its officers, directors, employees, and agents shall not be liable for any claims, damages, or losses arising from or related to participation in the Promotion, acceptance or use of any refund, or any technical issues affecting the Promotion, to the maximum extent permitted by law.

Governing Law

This Promotion and any disputes arising from it shall be governed by the laws of the State of California, without regard to conflict of law principles.
